CONDITIONS OF SALE
The sale will benefit the association "Mécénat Chirurgie Cardiaque, enfants du monde", no selling expenses will be added to the hammer price. PARTICIPATION :
The sale is public, and the following means are proposed to participate in the auction:
- physically by being present on May 6, 2022, at 6:00 pm, salle Jean Despas, place des Lices in Saint-Tropez. remotely by phone or by leaving a valid purchase order that we will execute on your behalf via the internet by registering beforehand on the drouot.com platform
PAYMENT :
The sale will be made expressly in cash: the successful bidder undertakes to pay personally and immediately the price of the adjudication pronounced.
The buyer will pay directly the association "Grand Prix Photo de Saint Tropez".
Means of payment :
- cash (on presentation of an identity document): Up to 1 000 € when the debtor has his fiscal residence in France or acts for the needs of a professional activity. Up to €15,000 when the debtor proves that he is not domiciled for tax purposes in France and is not acting for professional purposes.
- Cheque - transfer, - credit cards (visa, mastercard). In case of payment by check or by transfer, the withdrawal of the objects can be deferred until the cashing. In this case, the Grand Prix Photo Association may reserve the right to charge storage, transport and handling fees. A preliminary exhibition will allow the buyers to see the condition of the objects put on sale. No claim will be accepted once the auction has been pronounced. The information given in the catalog is the responsibility of the Auctioneer, taking into account the corrections announced at the time of the sale and recorded in the sale report. Dimensions, weights and estimates are given as an indication and do not constitute any guarantee. As of the adjudication, the object will be under the full responsibility of the buyer who will himself be responsible for insuring his acquisitions. BeaussaNt lefèvre & associés declines all responsibility for any damage that the object may incur, and this as of the adjudication pronounced. The order of the catalog will be followed. The sale of a work does not carry with it the right to reproduce it for the benefit of its owner.
DEFAULT OF PAYMENT :
In the absence of payment of the amount of the adjudication and the expenses, a formal notice will be sent to the buyer by registered letter with acknowledgement of receipt at the buyer's expense. At the end of the one month period following this formal notice and in the absence of
payment of the sum due, an additional fee of 10% of the auction price will be charged to the buyer to cover the costs of collection, with a minimum of 25 €. The application of this case does not prevent the allocation of damages and costs of the procedure which would be necessary, and does not prejudge the possible implementation of the procedure of "folle enchère". Irresponsible bidding: in the absence of payment by the successful bidder, after formal notice has remained unsuccessful, the property is put back on sale at the request of the seller on irresponsible bidding by the defaulting bidder: if the seller does not make this request within a period of one month from the date of the auction, the sale is automatically cancelled, without prejudice to any damages. PAIEMENT :
La vente sera faite expressément au comptant : l'adjudicataire s'engage à régler personnellement et immédiatement le prix de l'adjudication prononcée.
L'acheteur réglera directement l'association “Grand Prix Photo de Saint Tropez"
Moyens de paiement :
- espèces (sur présentation d'une pièce d'identité) : Jusqu'à 1 000 € lorsque le débiteur a son domicile fiscal en France ou agit pour les besoins d'une activité professionnelle. Jusqu'à 15 000 € lorsque le débiteur justifie qu'il n'a pas son domicile fiscal en France et n'agit pas pour les besoins d'une activité professionnelle.
- Chèque - virement,-cartes de crédit (visa, mastercard). En cas de paiement par chèque ou par virement, le retrait des objets peut être différé jusqu'à l'encaissement. Dans ce cas, l’association du Grand Prix Photo peut se réserver le droit de facturer des frais de magasinage, transport et manutention. Une exposition préalable permettant aux acquéreurs de se rendre compte de l'état des objets mis en vente, il ne sera admis aucune réclamation une fois l'adjudication prononcée. Les indications portées au catalogue engagent la responsabilité du Commissaire Priseur habilité compte tenu des rectifications annoncées au moment de la vente et portées au procès-verbal de la vente. Les dimensions, les poids et les estimations sont indiqués à titre indicatif et ne sauraient constituer une quelconque-garantie. Dès l'adjudication, l'objet sera sous l'entière responsabilité de l'acquéreur qui sera lui-même chargé de faire assurer ses acquisitions. BeaussaNt lefèvre & associés décline toute responsabilité quant aux dommages que l'objet pourrait encourir, et ce dès l'adjudication prononcée. L'ordre du catalogue sera suivi. DÉFAUT DE PAIEMENT :
A défaut de paiement du montant de l'adjudication et des frais, une mise en demeure sera adressée à l'acquéreur par lettre recommandée avec avis de réception aux frais de l'acquéreur. A l'expiration du délai d'un mois après cette mise en demeure et à défaut
de paiement de la somme due, il sera perçu sur l'acquéreur et pour prise en charge des frais de recouvrement un honoraire complémentaire de 10% du prix d'adjudication, avec un minimum de 25 €. L'application de cette cause ne fait pas obstacle à l'allocation de dommages intérêts et aux dépens de la procédure qui serait nécessaire, et ne préjuge pas de l'éventuelle mise en œuvre de la procédure de folle enchère. Folle enchère : à défaut de paiement par l'adjudicataire, après mise en demeure restée infructueuse, le bien est remis en vente à la demande du vendeur sur folle enchère de l'adjudicataire défaillant : si le vendeur ne formule pas cette demande dans un délai d'un mois à compter de l'adjudication, la vente est résolue de plein droit, sans préjudice de dommage. Intérêts dus par l'adjudicataire défaillant.
